New Fast-Track Solution for Rejected Canadian Study Visas: The 2024 Pilot Project You Need to Know

For those interested in studying in Canada, you may already know that the student visa rejection rate is the highest since 2019. Additionally, by 2025, the number of new study permits issued to international students will decrease by 10%, from the 2024 target of 485,000 to 437,000, and this reduced number of permits is expected to continue until 2026.

The Canadian Federal Court has announced the implementation of the Study Permit Pilot Project, which starts today (October 1st). This initiative aims to simplify the judicial review process for rejected study permit applications. Typically, when a student visa is rejected, applicants can challenge the decision through a judicial review in the Canadian Federal Court. Previously, this process could take 14-18 months. However, with the new pilot project, it can now be completed within five months.

  • Eligibility: International students who have applied for a study permit and received a rejection letter from Immigration, Refugees and Citizenship Canada (IRCC).
    1. Both the applicant and IRCC must agree to participate in the pilot project.
    2. The case (initial study permit application and the reason for rejection) must be straightforward, with no legal issues such as inadmissibility or national security concerns.
    3. No request for an extension of time to apply should be made.
    4. No new evidence can be submitted through affidavits.
    5. Applicants applying from within Canada must submit their application within 15 days of receiving their study permit rejection, while those applying from outside Canada have 60 days.
  • How to Apply: All documents must be submitted online using the court’s electronic filing system. Applicants must use Form IR-1 for the application and mention the pilot project in three places on the form. More details are available via the provided link.
